According to the National Prosecuting Authority, they received an order from the country’s highest court notifying them of the decision.
The state is seeking 15 years minimum in prison for the former Olympic blade runner who shot dead his girlfriend Reeva Steenkamp in 2013.
Pistorius is currently out on a bail of about 600 US dollars since December 2015 after he was found guilt of murder for shooting Steenkamp.
Previously he was given a lesser charge of culpable homicide and was handed a five year prison sentence before the Supreme Court of Appeal convicted him of murder.
The double amputee will be sentenced on April 18.
