TANZANIA: Government to be sued over Construction through th


  1. Nairobi, Decemebr 9, 2010- A leading Pan African organization working in conservation and animal welfare will move to the East African Court of Justice (EACJ) to seek an interim order of injunction to restrain the United Republic of Tanzania from constructing a super highway through the Serengeti Game Reserve.
    Lawyer Saitabao Ole Kanchory of Kanchory & Co. Advocates representing the Africa Network for Animal Welfare (ANAW) will file the case at the EACJ in Arusha Tanzania on Thursday 9th December 2010. Besides interim order of injunction, ANAW will also be asking the EACJ to declare that the action to construct the road is unlawful and infringes on the provisions of the East African Community Treaty; and a Permanent Injunction prohibiting Tanzania from constructing the highway.
    The move to court follows the persistency by the government of the United Republic of Tanzania to implement the plan in full knowledge that the action is unlawful and infringes provisions of the EAC Treaty specifically Articles 5, 89, 111, 112, 114 and 116.
    Despite conceding the serious ecological and environmental hazards of the road, identifying and acknowledging more than 15 severe negative impacts of implementing the project in its official Environmental and Social Impact Assessment (ESIA) Report, Tanzania still proposes to proceed with the construction of the Natta-Mugumu-Tabora B–Klein’s Camp-Loliondo road upgrading project.
    The major impacts identified and acknowledged include; increased poaching activities, disruption of wildlife corridor, increased mortality of wild animals due to collision with speeding vehicles, delays in animal migration leading into fragmentation of animal habitats and so weakening or disappearance of an entire generation of a given population, noise and vibrations during construction activities may scare and cause migration of animals in National Park and game controlled area and deterioration of air quality to be occasioned by stockpiling of construction materials, fumes and dust from machinery, equipment and vehicles.
