Panic gripped the political class of Kenya when news broke that former UN Secretary General Kofi Annan handed over the envelope containing the list of perpetrators of the post election violence to the International Criminal Court. The Prosecutor of the ICC Luis Moreno O'Campo is keeping the list.

President Mwai Kibaki summoned an urgent meeting with the Prime Minister and the Mediation Team at the State House on Thursday. The Lands Minister, James Orengo, who was addressing the press in his office, then had to cut short his speech to rush to the meeting. Orengo was part of the Mediation Team that agreed to the terms contained in the agreement that ended the post election violence.
Dr Annan informed Kenya President Kibaki and Prime Minister Raila Odinga in a letter that the Panel of Eminent Persons handed over the names to the ICC. "I wish to inform you that the Panel of Eminent African Personalities has handed over to the Prosecutor of International Criminal Court, the sealed envelope and supporting materials entrusted to me by the Waki Commission on 17th October 2008,” part of the letter read.
His decision comes barely after a Kenyan delegation to the ICC secured an extension for the deadline to set up a tribunal to try the violence suspects. The Waki Commission recommended the formation of a tribunal to try the suspects but the Kenyan leadership has been skirting around. Last year, two bills seeking to amend the Constitution and to establish the tribunal were shot down by Parliament.
Over 1,200 people lost their lives in the post election violence that rocked Kenya during the 2007 general election. Over 350,000 other people were displaced. Although many have been resettled there are over 30,000 people who are still living in old and tattered tents in camps for the Internally Displaced.
