KENYA: ICC SUSPECT SUMMONED OVER GRABBED LAND


  1. A member of parliament who is also facing charges of crimes against humanity at the International criminal Court, has been ordered by a kenyan court to appear in court during the hearing of a case in which he has been accused of grabbing and occupying the land of a victim of the post election violence.

    William Samoei arap Ruto was orderred by High Court judge, Justice Rose Ougo directed that Ruto appears in court on February 4 and 5 2013 when the case will be heard. Ruto is also required to appear with his defendants on the said date.

    An internally displaced person, mr Adrian Muteshi, sued Mr Ruto for what he terms as grabbing his land after he (Muteshi), fled at the height of the post election violence that rocked Kenya after the disputed election of 2007-8. he claims that mr Ruto illegally took his 100 acre piece of land situated at Kaptabei Scheme, Turbo, in Uasin Gishu District. Kaptabei is in Eldoret North constituency, an area represented in parliament by Ruto.


    In his sworn evidence, mr Muteshi said that he, together with his six workers, we kicked out of his farm during the post election violence, and has not been able to go back because the land has since then been occupied by Ruto. Apart from seeking the return of his land, MrMuteshi is also demanding that mr Ruto pays him the cost of the suit.


    On his part, mr Ruto claims that the land was sold to him by another person, and he did not know that it belonged to mr Muteshi at the time he bought the land. he has offered to return it to Muteshi. Earlier on, Mr Ruto had offered to settle the matter out of court, but it seems things did not work out between the two, hence the court summons. William Ruto is currently one of the top three gunners for the leadership of Kenya, in the so called Jubilee Coalition, together with his co-accused, Uhuru Kenyatta. If elected, William Ruto will be the Vice President, while Uhuru president as per their pre-election agreement. The other contedner for the top seat in the coalition is Wycliffe Musalia Mudavadi.


    William Ruto and Uhuru Kenyatta are meant for ICC in the Hague on April 4 2013 for the hearing of the cases. So far, there European Union has banned them from setting foot in the countries within the eurozone. Other international bodies have expressed their displeasure with the duos political activity, saying that Kenya faces sanctions if the two are elected nd fail to appear at the ICC.
